1. Acceptance of Terms

By downloading, installing, or using Coloring Pals ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

If you are under 18 years of age, you must have your parent or guardian's permission to use this App and they must agree to these Terms on your behalf.

2. Description of Service

Coloring Pals is a mobile application that provides:

Digital coloring pages and tools
A social platform to share colored artwork
Premium subscription features
Community interaction features (likes, comments)

3. User Accounts

3.1 Account Creation

You may use basic coloring features without an account
Social features require account creation
You must provide accurate information when creating an account
You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Eligibility

Users under 13 require verifiable parental consent for social features
You may only create one account per person
Accounts are non-transferable

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent or illegal activity
Post inappropriate content
Harass other users

4. Subscription Terms

4.1 Subscription Plans

Coloring Pals offers the following subscription options:

4.2 Premium Features Include:

Unlimited access to all coloring pages
Ad-free experience
Exclusive premium content
Advanced coloring tools
Priority support

4.3 Billing and Renewal

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your account settings on the App Store or Google Play Store

4.4 Free Trial

If offered, free trial period will be specified at sign-up
Unused portion of free trial is forfeited when purchasing a subscription
Free trial is available once per user/device

4.5 Refunds

Refund requests are handled by Apple App Store or Google Play Store according to their respective policies
We do not directly process refunds

4.6 Price Changes

We may change subscription prices at any time
Price changes will not affect your current subscription period
You will be notified of price changes before your next renewal

5. User Content

5.1 Your Content

"User Content" includes any artwork, images, comments, or other materials you create, upload, or share through the App.

You retain ownership of your original User Content. By posting User Content, you grant Coloring Pals a worldwide, non-exclusive, royalty-free license to:

Display your content within the App
Use your content for promotional purposes
Store and backup your content

5.2 Content Guidelines

You agree NOT to post content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
Is sexually explicit or pornographic
Depicts violence or gore
Promotes discrimination, bigotry, racism, or hatred
Infringes on intellectual property rights
Contains personal information of others without consent
Contains spam, advertising, or commercial solicitations
Impersonates another person or entity
Contains malware, viruses, or harmful code
Violates any applicable laws or regulations

5.3 Content Moderation

We reserve the right to:

Review, screen, and moderate User Content
Remove or disable access to any User Content that violates these Terms
Take appropriate action against users who violate Content Guidelines
Report illegal content to relevant authorities

5.4 Copyright Infringement

If you believe your copyright has been infringed, please contact us at yatkineren @gmail.com with:

Description of the copyrighted work
Location of the infringing content in the App
Your contact information
A statement of good faith belief
Your signature (electronic or physical)

6. Prohibited Activities

You agree NOT to:

Use the App for any illegal purpose
Attempt to gain unauthorized access to the App or its systems
Interfere with or disrupt the App's functionality
Reverse engineer, decompile, or disassemble the App
Use automated systems (bots, scrapers) on the App
Collect user information without consent
Sell, trade, or transfer your account
Create multiple accounts to abuse features or promotions
Circumvent any security measures
Use the App to harass, bully, or harm others

7. Intellectual Property

7.1 Our Property

The App, including its original content, features, functionality, design, graphics, and trademarks, is owned by Coloring Pals and protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7.3 Restrictions

You may not:

Copy, modify, or distribute the App's content
Use the App's content for commercial purposes without permission
Remove any copyright or proprietary notices
Create derivative works based on the App

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT:

The App will be uninterrupted or error-free
Defects will be corrected
The App is free of viruses or harmful components
The results of using the App will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLORING PALS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Any damages resulting from unauthorized access to your account
Any damages resulting from User Content posted by others

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless Coloring Pals, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your User Content
Your violation of any third-party rights

11. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms in the App
Sending a notification through the App
Updating the "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at yatkineren @gmail.com.

14.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with Istanbul Arbitration Centre (ISTAC) Rules.

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Coloring Pals regarding the use of the App.
